Terms and Conditions

The Kids Village Terms and Conditions

Registration, Bookings, Notice Periods and Fees

 

1.       To register your child at the nursery, a non-refundable registration fee of £50.00 is payable to secure a place. The registration fee is not payable for children that attend nursery for fully funded sessions only.

2.      On booking a place at The Kids Village, we require a minimum of 2 sessions a week (mornings or afternoons count as one session, and full days count as two sessions). Booked sessions cannot be changed or swapped however additional one-off sessions can be booked on an ad hoc basis.

3.      Fees include morning and afternoon snack and lunch.

4.       We reserve the right to adjust the fees to reflect increases in our costs of providing our services. We will give you no less than four weeks’ prior notice in writing of the fee increase.

5.      All fees are invoiced monthly, in advance, and must be paid by bank transfer or tax- free childcare voucher by or on the first day of the month to which they relate. We are unable to accept cash or cheques. 

6.     Late payments by more than 30 days are subject to a surcharge of 5% of the amount outstanding. In addition, your child may be excluded from the nursery if fees remain outstanding more than 30 days beyond the 1st of the month. Any reasonable costs incurred by The Kids Village resulting from outstanding fees, such as legal, bank or administrative charges, will be chargeable in full to the bill payer. 

7.      A late collection fee of £ 12.00 per 15 min will be charged to parents. this fee will also apply to early drop-offs prior to session start time. This will pay for any additional operational costs that caring for a child outside their normal nursery hours may incur. These charges start 1 minute after the end of the child’s normal session, i.e, 1.01 pm or 6.01 pm. Payment of this late fee is required when invoiced. This fee will also apply to early drop-offs prior to session start times.

8.     Fees remain payable during periods where your child is absent from the nursery, including sickness and holidays.

9.     The Kids Village is open all year except for the Christmas holidays when we are closed from 25th of December and reopen on the 2nd of January (or the following Monday if the 2nd falls on a Saturday or Sunday). Fees are not payable for the days we are closed over Christmas. 

 

 

10.      For funded only sessions there is a choice of splitting your funding entitlement over either a term time 38-week schedule or a full year 50-week schedule. The holidays associated with these attendance patterns are issued to parents in advance in August, at the beginning of the funded year. If parents wish their child to attend nursery on any funded holidays it will be necessary to book these days as additional ad hoc sessions.

11.     Additional ad hoc sessions are charged at the usual session rate, and payment is required at the time of booking. Early Years Funding Entitlement hours cannot be used in relation to payment for extra sessions.  Ad hoc sessions are subject to room capacity availability and cannot be booked more than 1 month advance. 2 week’s written notice is required to cancel or make changes to ad hoc booked sessions, failure to do so will result in full payment being taken.  Unused booked sessions are not refundable.

12.     If you wish to change your booking pattern, this is subject to availability and reducing sessions needs a minimum of four weeks’ notice.  

13.     Four weeks’ written notice is required if you wish to cancel your space. Your fees are still payable throughout the notice period. Once a place at the nursery has been confirmed, the notice period applies, and fees are payable if there is any delay in taking up the place. Any changes to the agreed start date must be made in writing a month in advance. 

14.    Attendance cannot begin until your first months’ fees are paid.


Safety & Wellbeing

15.    If your child becomes unwell whilst in our care, we will contact you.  If senior staff feel your child is not well enough to remain at nursery, you will be asked to arrange collection of your child as soon as possible. Please note that if your child requires medication, for example Calpol, to reduce pain or temperature prior to attending nursery then they are too unwell to be in nursery and staff will not be able to accept them into nursery.

16.    If your child is unwell, we ask that you contact the nursery to inform them of their absence. The nursery must be informed if your child is suffering from any contagious disease to ensure we can effectively communicate to all parents/carers any communicable diseases in the nursery.  For the benefit of other children and staff, we ask that your child remain at home until they have returned to full health. 

17.          If you child is displaying diarrhoea or sickness they must be kept at home for 48 hours after symptoms cease before returning to nursery. If your child is displaying a high temperature, they must maintain a normal temperature for 24 hours before returning to nursery. If a new medicine or new antibiotic is prescribed for your child then they must not attend nursery until 4 hours after the first dose is administered, this is in case your child has an adverse reaction. 18.    We will only allow you or person(s) authorised by you to collect your child from our nursery setting. If a person you authorise to collect your child is not known to the nursery staff, the parent must tell staff who the person is that is collecting the child and provide a detailed description of this person. This designated person must also know the individual child’s safety password to allow the nursery to release the child into their care. This is the responsibility of the parent.

19.    We will work with you to cater for specific dietary and medical requirements of your child. You must notify the nursery in writing if there are changes to a special diet or medical condition so that we can ensure all paperwork is updated.

20.    Any information communicated or advised to you by a medical professional must be shared with the nursery to ensure your child’s safety and health is suitable catered for.

21.    Please ensure that your child’s personal details on Famly are correct and any changes to your address or contact details are communicated to the nursery, as soon as possible.

22.    We have a duty of care to ensure that any significant concerns about the children in our care are reported to Social Services and, where appropriate, Care Inspectorate. We may note any incident or observation of a child where we deem the child may have been, or may be in the future, at risk of harm or neglect. In exceptional cases this may be done without speaking to a you until we have sought external advice.

23.    In exceptional circumstances there may be an event that triggers the closure of the nursery that is out of our control. Such events include, without limitation, ‘acts of God’, fire, war, acts of terrorism, strikes or other industrial action, infectious diseases, and epidemics, and The Kids Village will not issue refunds for such forced closures.

24.     The Kids Village will not tolerate, under any circumstances, behaviour towards staff which is deemed to be threatening, abusive or violent, or behaviour which undermines the reputation of the nursery or its staff. Any such behaviour may result in termination of your child’s nursery place, or a refusal to allow the person back on the premises in the future. Any disruption in nursery caused by a parent/carer or child that is deemed inappropriate or not conducive to a nursery environment, will be cause for the parent/carer and child to be asked to leave the premises.

25.    We may suspend the provision of childcare if your child’s behaviour at nursery endangers the safety and wellbeing of the other children or staff at the nursery. The suspension shall continue whilst we try and address these problems with you.

26.    The Kids Village cannot take responsibility or liability for any services provided by our staff outside of our provision (such as babysitting). If you use any of our employees to provide services to you, you acknowledge and agree that this contract is kept entirely between yourselves and the individual, and in no way involves Yard.

 

General

27.    We expect all parents/carers to read and adhere to our policies and procedures regarding illness and absence, medication, dietary requirements, safeguarding children, security, behaviour, equal opportunities, complaints, among others. All relevant policies can be accessed in the nursery. 

28.    The Kids Village reserves the right to terminate your child’s place providing at least four weeks’ notice in writing, or immediately in the event of a breach of these T&Cs which (if remediable) has not been remedied within 14 days.

29.    The Kids Village reserves the right to change any element of these T&Cs without notice where such a change arises from regulatory or legal requirements, or by providing reasonable notice for non-regulatory or statutory amendments.

30.    The Kids Village does not accept responsibility for accidental injury or loss of damage to property. The nursery is not responsible for any items left by you at the nursery, including without limitation, pushchairs, prams, car seats, toys or clothing. All personal items brought to nursery, including all clothing, should be clearly marked with the child’s name so they can be easily identifiable. Personal toys are not permitted.

31.   The Kids Village take our data protection obligations in relation to the processing of your personal data very seriously. For more information on how we your personal data and you rights in relation to your personal data please see our GDPR policy. 

32.   This version of our nursery Terms and Conditions cancels and replaces all previous versions of our Terms and Conditions and do not affect any other legal rights that you may have.

 

These Terms and Conditions govern our provision of Services so please ensure that you read these Terms and Conditions carefully. If you are unsure about any part of these Terms and Conditions, please just ask and we will be happy to discuss them further with you. 

By continuing to use our services at The Kids Village you are entering into and agreeing to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please notify us as soon as possible and cease using our provision with immediate effect. 

These Terms and Conditions are subject to change, and you will be notified of any material changes. Your continued use of our provision will indicate your acceptance of any revised Terms and Conditions.
